Cambria Terms of Service

1. Acceptance of Terms

By accessing or using the Cambria website at cambriausa.com and any related digital properties (collectively, the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must immediately discontinue your use of the Site. These Terms constitute a legally binding agreement between you and Cambria Company ("Cambria," "we," "our," or "us"), a Minnesota corporation.

Your continued use of the Site following the posting of any amendments to these Terms shall be deemed your acceptance of such amendments. We encourage you to review these Terms periodically.

2. Permitted Use of Website

The Site is provided for lawful, personal, and commercial information purposes related to Cambria's products and services. You agree not to:

• Use the Site in any way that violates applicable federal, state, or local laws or regulations
• Engage in any data mining, scraping, or systematic retrieval of Site content without express written permission
• Introduce viruses, trojans, worms, or other malicious or technologically harmful material to the Site
• Attempt to gain unauthorized access to any part of the Site or its related systems or networks
• Use automated systems or bots to interact with the Site's inquiry forms or sample request functionality

3. Intellectual Property

All content on this Site, including without limitation text, photographs, graphics, design elements, logos, the Cambria trade name and its collection names (including Brittanicca, Ironsbridge, Everleigh, Montgomery, Portrush, Torquay, Skara Brae, and all other named colorways), are owned by or licensed to Cambria and are protected by United States and international copyright, trademark, and other intellectual property laws.

You may view and download content from the Site for personal, non-commercial use only, provided you do not modify or remove any copyright, trademark, or other proprietary notices. Any other use requires prior written consent from Cambria.

4. Product Information & Availability

Cambria makes reasonable efforts to ensure that product information displayed on the Site is accurate. However, we cannot guarantee that product descriptions, colorway photography, dimensions, or technical specifications are complete, current, or error-free. Digital displays and monitor calibrations mean that colors viewed on screen may not precisely represent the actual product.

We strongly recommend requesting physical samples before making purchasing decisions. Product availability, colorway discontinuations, and pricing are subject to change without notice. Contact your local authorized Cambria dealer for current product availability and pricing in your region.

5. Inquiries, Samples & Orders

Submission of inquiry forms, sample requests, or project consultation requests on this Site does not constitute a binding order or guarantee of supply. Cambria sales are processed exclusively through authorized dealer and fabricator partners. Cambria does not sell directly to end consumers and is not responsible for pricing, availability, fabrication quality, or installation provided by third-party dealers or fabricators.

Free sample requests are subject to availability and limited to personal, residential evaluation purposes. Cambria reserves the right to limit sample quantities per household and to decline requests at its discretion.

6. Warranty Disclaimer

THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Separate warranty terms governing Cambria's physical products are available through authorized dealers and are distinct from these Terms.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CAMBRIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, INCLUDING WITHOUT LIMITATION ANY LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF CAMBRIA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. CAMBRIA'S TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

8. Privacy Policy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by this reference. By using the Site, you consent to the collection and use of your information as described in the Privacy Policy.

9. Changes to Terms

Cambria reserves the right to modify these Terms at any time. We will post the revised Terms on this page with an updated effective date. These Terms are governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Hennepin County, Minnesota.
